Common Ground Code of Conduct

These Terms of Service govern your use of the Common Ground Markets website, your participation in any Common Ground market as a vendor, and your visit to the Common Ground property at 550 Somerset Terrace NE, Atlanta, GA 30306.

By accessing our website, submitting a vendor application, or entering the Common Ground premises, you agree to these terms. If you do not agree, please do not use our website or visit our property.

About Common Ground Markets

Common Ground Markets operates a Daily Market, a Saturday Farmers Market, and a Sunday Makers & Designer Market at 550 Somerset Terrace NE on the Atlanta BeltLine Eastside Trail. These terms apply to all three markets and all associated activities on the premises.

Website Use

Our website is provided for informational purposes and vendor applications. You agree not to use the site to transmit harmful, fraudulent, or unlawful content. We reserve the right to modify, suspend, or discontinue any part of the website at any time without notice.

All content on the Common Ground Markets website — including text, images, logos, and design — is the property of Common Ground Markets and may not be reproduced, distributed, or used without written permission.

Vendor Participation

Vendor participation is governed by the Vendor Agreement signed prior to each season or lease term, along with the Vendor Policies and Procedures. In the event of a conflict between these Terms of Service and your Vendor Agreement, the Vendor Agreement controls.

Acceptance into any Common Ground market is at the sole discretion of Market Management. We reserve the right to accept, decline, or terminate any vendor's participation at any time, for any reason, with or without cause.

All fees paid to Common Ground Markets are non-refundable unless otherwise stated in your Vendor Agreement or required by law.

Assumption of Risk

Visiting or vending at Common Ground Markets involves inherent risks, including but not limited to exposure to food allergens, crowded conditions, weather, and the actions of other visitors or vendors. By entering the premises, you voluntarily assume these risks.

Common Ground Markets is not responsible for lost, stolen, or damaged personal property. Vendors are solely responsible for securing their inventory, equipment, and personal belongings.

Limitation of Liability

To the fullest extent permitted by law, Common Ground Markets, its owners, operators, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website, your participation as a vendor, or your visit to the property. This includes, without limitation, damages for personal injury, property damage, lost revenue, or business interruption.

In no event shall Common Ground Markets' total liability to you exceed the total fees you have paid to Common Ground Markets in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Common Ground Markets, its owners, operators, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the website, your participation as a vendor, your presence on the property, your products or services, or your violation of these Terms of Service.

Insurance (Vendors)

All vendors must maintain general liability and property damage insurance of no less than $1,000,000, including product liability coverage, naming Common Ground Markets and 550 Somerset Terrace NE as additional insureds. Proof of insurance is required prior to participation.

Intellectual Property

The Common Ground Markets name, logo, and all associated branding are the property of Common Ground Markets. Vendors may not use Common Ground branding in their own marketing materials without prior written approval.

By submitting photos, descriptions, or other content as part of your vendor application or profile, you grant Common Ground Markets a non-exclusive, royalty-free license to use that content for marketing and promotional purposes.

Photo and Media Release

By entering the Common Ground premises — whether as a vendor, shopper, or visitor — you consent to being photographed, filmed, or otherwise recorded. This content may be used in any and all media in connection with Common Ground Markets. You waive any claims to compensation, royalties, or rights of publicity or privacy related to such use. If you do not consent, please contact us before visiting.

Dispute Resolution

Any dispute arising out of or related to these Terms of Service shall be governed by the laws of the State of Georgia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia.

Before initiating any formal legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us using the Contact button above. We'll make a good-faith effort to resolve the matter within 30 days.

Termination

We reserve the right to terminate or restrict your access to our website, property, or markets at any time, for any reason, with or without notice. All provisions of these Terms that by their nature should survive termination shall survive, including indemnification, limitation of liability, and dispute resolution.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Amendments

Common Ground Markets reserves the right to update these Terms of Service at any time. Updated terms will be posted on our website. Your continued use of the website or participation in the market constitutes acceptance of the revised terms.
